Street racing is against the law in New Jersey. New Jersey prohibits street racing in order to make the streets and highways safe for drivers and pedestrians. What is Street Racing?
Street racing is a traffic offense. New Jersey statute defines street racing as occurring when a person operates, attempts to operate, or agrees to operate a motor vehicle on a public highway in any of the following ways:
- In a race with another motor vehicle; or
- For the purpose of making a speed record
A person that arranges, manages, encourages, or assists in the holding of or the attempt to hold any race or speed event can also be cited for participating in street racing.
Punishment for Street Racing
Street racing may result in a fine and imprisonment. If convicted, the punishment for street racing or the making of speed records is the following:
First Offense
- A fine of no less than $25 but not more than $100
Second and Subsequent Offenses
- A fine of no less than $100 but not more than $200
- Imprisonment for no more than 90 days
Points for Street Racing
New Jersey assigns a point value to a street racing traffic offense. In New Jersey, a street racing violation will result in the addition of five points to a person’s driving record. If this results in excessive points on a driver’s record, the driver will have to pay a surcharge in addition to any other fines.
